These Terms and Conditions ("Terms") govern the use of the Kjellermester app and related services. By downloading, registering an account, or otherwise using Kjellermester, you confirm that you have read, understood, and accepted these Terms as well as our Privacy Policy. If you do not agree to the Terms, you may not use the service. 1. About the service Kjellermester is a mobile and web-based application that helps you manage your wine collection. The service allows you to digitally register your wine bottles, recognize wine labels using your camera (with AI support), receive recommendations for wine pairings, and maintain a clear overview of your cellar inventory. The service is owned and operated by the team behind Kjellermester ("we" or "us"). We reserve the right to update or change the app’s content and functionality over time in order to improve the service. We will do our best to inform you of any significant changes. 2. Creating an account To use Kjellermester, you must create a user account. When registering, you must provide accurate and complete information, including a valid email address. You are responsible for keeping your account information up to date. Age requirement: You must be at least 18 years old to create an account and use this app, as it relates to alcohol products. By registering, you confirm that you are over 18. We reserve the right to close accounts if it is discovered that the age requirement is not met. Account and password security: You are responsible for keeping your password confidential and for preventing unauthorized access to your account. Do not share your login credentials. If you suspect unauthorized access, notify us immediately. You are responsible for all activity that occurs under your account. One account per user: Each person may only create and use one account, unless otherwise explicitly agreed. Misuse of multiple accounts may result in suspension. 3. Use of the service By using Kjellermester, you agree to comply with these Terms and applicable laws. Below are guidelines for acceptable use: Personal and lawful use: Kjellermester is for your personal, non-commercial use only. Do not use the app for illegal purposes, such as planning unauthorized alcohol distribution. User-submitted content: You retain ownership and responsibility for all content you submit (e.g. wine information, label photos, notes). You must have the necessary rights to share such content. Do not upload illegal, offensive, or infringing material. We do not pre-screen user content but reserve the right to remove or modify any content that violates the Terms or applicable law. Prohibited behavior: You must not misuse the service. This includes attempting to bypass security features, introducing malware (e.g. viruses, worms), or interfering with the app’s functionality. Data scraping or automated access is also prohibited. Violations may lead to suspension or termination of access. Respecting others: If the app introduces features for user interaction (e.g. sharing recommendations), you must behave respectfully. Harassment, impersonation, or discrimination is not tolerated. Violations may result in warnings, temporary suspension, or permanent bans. Serious violations may be reported to the authorities. 4. Subscriptions and payments Kjellermester is currently free to download and use with all core features. In the future, we may introduce paid features or subscriptions. If so, the following terms apply: Prices and purchases: Any fees will be clearly stated before you make a purchase. Payment processing: Purchases via the Apple App Store or Google Play follow their rules. We do not store full card details; all sensitive information is processed by trusted third parties. Auto-renewal: If using subscriptions, they will renew automatically at the end of each billing cycle unless you cancel. You can cancel auto-renewal at any time. Cancellations and refunds: You can manage or cancel subscriptions via the platform you used (e.g. App Store, Google Play). Cancellations take effect at the end of the current period. We follow consumer laws for refunds, meaning you typically won’t be refunded for ongoing periods, but you’ll retain access until expiry. Contact us for help with any payment issues. 5. Intellectual property Our rights: We (the developers of Kjellermester) own all intellectual property rights to the app and its content, including source code, design, trademarks, logos, databases, and all other original materials. These are protected by copyright and other laws. You are granted a limited, personal, non-exclusive, revocable license to use the app in accordance with these Terms. You may not copy, modify, distribute, sell, or reverse-engineer any part of the Kjellermester app or content without written permission. Your content: You retain ownership of the content you submit to the app, including wine data, label photos, and notes. By submitting this content, you give us permission to store and process it in order to deliver the service (e.g. storing images securely, showing them in your account, analyzing them with AI). Feedback: We welcome suggestions and ideas for improvement. By submitting feedback, you agree we may use it freely to improve Kjellermester, without obligation to compensate you. You waive any intellectual property rights to feedback suggestions. 6. Limitation of liability While we aim to make Kjellermester a reliable service, we must include disclaimers: As-is service: Kjellermester is provided “as is”, without any warranties. We do not guarantee error-free or uninterrupted operation. We also do not guarantee that AI-generated recommendations will be 100% accurate or suitable. Use your own judgment as you would with a human wine expert. Indirect damages: We – and our partners – are not liable for indirect or consequential losses, including lost profit or lost data, resulting from your use of (or inability to use) the app. Direct liability: To the extent permitted by law, our direct liability is limited to the amount you paid for the service (if any). We are not responsible for issues beyond our control – including third-party outages, power failure, or force majeure. Consumer rights: These Terms do not override your mandatory rights as a consumer. Norwegian law grants you protections (e.g. right of withdrawal), and these take precedence. 7. Third-party services and external links Kjellermester relies on third-party providers (see Privacy Policy). We select trusted partners and sign data processing agreements. However: External services: We cannot guarantee the performance of third parties (e.g. Supabase, AI services). We will assist with resolving issues but cannot be held responsible for them. External links: The app may include links to external sites (e.g. wine producer websites or articles). We are not responsible for their content or actions. Use them at your own risk and refer to their terms and privacy policies. App platforms: When using Kjellermester through the App Store or Google Play, you also agree to their terms. Apple and Google are not parties to this agreement and are not responsible for support or losses. They are considered third-party beneficiaries who may enforce these Terms if necessary. 8. Changes to the Terms We may update these Terms when needed (e.g. due to feature changes or new laws). Changes will be published on our website and/or in the app. If the change is significant, we’ll notify you via app, email, or other reasonable means. By continuing to use Kjellermester after an update, you accept the new Terms. If you disagree, stop using the app and contact us to close your account. 9. Governing law and disputes These Terms are governed by Norwegian law. If a dispute arises, we aim to resolve it amicably. If unresolved, either party may bring the case to Norwegian courts.
